BY AGREEING TO THE TERMS OF THIS AGREEMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS.
Definitions
rOaD.lEsS.tRAvELEd refers to:
rOaD.lEsS.tRAvELEd (SMC-PVT.) Limited, including its subsidiaries, affiliates, related companies, directors, officers, employees, subcontractors, suppliers, agents, guides, volunteers, independent contractors, representatives, owners, insurers, successors, and assigns (individually and collectively referred to as “rOaD.lEsS.tRAvELEd”).
Activities
The activities and services provided, arranged, or organized by rOaD.lEsS.tRAvELEd based on my chosen itinerary. These may include but are not limited to:
- Adventure travel tours
- Canyoneering, caving, cycling, mountain biking
- Hang-gliding, parasailing, paragliding
- Horse riding and other equine activities
- Hot air balloon rides, off-road transportation
- Rock/rope climbing, rappelling, zip-lining
- Crossing suspension bridges
- Swimming in lakes, ponds, rivers, oceans, canals
- Scuba diving, helicopter activities
- White water rafting, travel in jet boats/speed boats, sailing
- Trekking, mountaineering, surfing
- Travel in public and private transportation, including to and from tour areas
Acknowledgment – Health & Safety
I understand that participating in the Activities requires physical exertion that may activate or aggravate pre-existing injuries, conditions, or congenital defects.
I acknowledge that I should seek medical advice if I suspect my physical condition may not be compatible with the Activities.
I am required to wear approved safety equipment for certain activities and acknowledge that guides and instructors are available to answer questions about proper equipment use.
Assumption of Risks
I am aware that participating in the Activities involves numerous risks, dangers, and hazards, including but not limited to:
- Personal injury or fatality
- Travel to remote areas without access to medical facilities or treatment
- Changing weather conditions
- Interactions or encounters with wildlife
- Equipment malfunctions or lack of telecommunication signals
- Negligence of other participants, guides, or rOaD.lEsS.tRAvELEd staff
- Consumption of alcohol or illegal substances
- Collisions with vehicles, equipment, or structures
- Becoming lost or separated from guides or participants
- Failure to remain within designated areas
Alcohol and Illegal Substances
If I use, consume, or am under the influence of alcohol or illegal drugs before or during the Activities, I assume and accept all risks, dangers, and hazards resulting from this, including but not limited to:
- Personal injury, death, property damage, loss, or arrest.
I will indemnify rOaD.lEsS.tRAvELEd from any liability for property damage or injury to any third party caused by my actions.
Waiver of Liability
Acceptance of Risks
I confirm that I am not relying on any oral or written representations or statements by rOaD.lEsS.tRAvELEd about the safety of the Activities, other than what is stated in this Waiver.
I freely accept and fully assume all risks, dangers, and hazards associated with the Activities, including the possibility of injury or loss.
Release of Liability, Waiver of Claims, and Indemnity
In consideration of rOaD.lEsS.tRAvELEd allowing me to participate in the Activities, I agree to the following:
- Waiver of Claims:
I waive any and all claims I have or may have in the future against rOaD.lEsS.tRAvELEd, including claims for loss, damage, expense, or injury arising from participation in the Activities, including those caused by the risks outlined in this Waiver. - Release from Liability:
I release rOaD.lEsS.tRAvELEd from any and all liability for loss, damage, or injury resulting from my participation in the Activities. - Indemnity:
I agree to hold harmless and indemnify rOaD.lEsS.tRAvELEd for any damage to property or personal injury to third parties caused by my participation in the Activities. - Binding Agreement:
This Agreement is effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.
Jurisdiction and Governing Law
- Applicable Laws:
This Agreement and any disputes arising from it will be governed by the Laws of Pakistan. - Jurisdiction:
Courts in the Islamabad Capital Territory will have exclusive jurisdiction over all disputes related to this Agreement.
Acknowledgment and Acceptance
I have read and fully understand this Agreement, including the waiver of my legal rights.
By agreeing to this Waiver, I confirm my acceptance of all risks and conditions associated with participating in the Activities.
